Shisha Ban Lifted as High Court Rules Regulations Expired

The High Court in Kenya has lifted the shisha ban in Kenya. The court said that it is not right to keep enforcing the shisha ban in Kenya. This is because the shisha ban in Kenya is against the law and the constitution of Kenya.

Justice Bahati Mwamuye made this decision. He said that the rules about shisha smoking in Kenya are not valid anymore. This is because the government of Kenya did not follow the procedure to make these rules valid within the time given by the court in 2018.

The court found out that the government of Kenya cannot use these rules to stop people from smoking shisha in Kenya. The court also said that some announcements made by the government of Kenya on February 3 2025 and April 14 2025 are not right. These announcements were about stopping people from smoking shisha in Kenya over the country.

Justice Bahati Mwamuye also said that the government of Kenya is not allowed to enforce these rules on people who are part of the Novel Tobacco Products Association. This is because it would be against their rights as citizens of Kenya.

This decision is a deal in the long fight about the shisha ban in Kenya. The government of Kenya had introduced the shisha ban in Kenya in 2017 because of health concerns. The government of Kenya had said that the shisha ban in Kenya was still in place while they were working on rules.

This decision will have an impact on how shisha laws are enforced in Kenya. The government of Kenya is now thinking about what to do. The shisha ban in Kenya is no longer in place. This will affect the shisha business, in Kenya.
